Terms of Service

Welcome to FamilyLawTools LLC. This Terms of Service agreement (“Terms”) is a binding contract between you (the “User,” “Customer,” or “you”) and FamilyLawTools LLC, a Colorado limited liability company (“FamilyLawTools,” “we,” “our,” or “us”). These Terms govern your access to and use of our software, platforms, and websites, including familylaw.tools (collectively, the “Platform”).

By creating an account, accessing, or utilizing the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms, along with our Privacy Policy. If you are accepting these Terms on behalf of a law firm, agency, or other legal entity, you represent that you have the authority to bind that entity to this agreement.

1. Platform Access and User Accounts

1.1 User Categories

The Platform is designed exclusively for use within the United States legal system and is restricted to the following user types:

  1. Legal Professionals: Licensed attorneys in good standing within their practicing jurisdictions.
  2. Support Staff: Paralegals, legal assistants, or administrative personnel working under the direct supervision of an authorized attorney.
  3. Self-Represented Litigants: Individuals representing themselves (pro se) in active family law matters.

1.2 Account Security and Credentialing

Access to the Platform requires a registered account. You agree to provide a valid, professional email address (generic aliases like “admin@” are prohibited). Login credentials are strictly tied to individual users; sharing usernames or passwords across multiple individuals, even within the same organization, is strictly prohibited and constitutes a material breach of these Terms.

2. License and Acceptable Use

2.1 Grant of License

Subject to compliance with these Terms, FamilyLawTools grants you a limited, revocable, non-transferable, and non-exclusive license to access and use the Platform for its intended legal and administrative purposes.

2.2 Prohibited Conduct

To maintain the integrity of our software, you agree that you will not:

  1. Reverse engineer, decompile, or disassemble any portion of the Platform’s source code or underlying architecture.
  2. Modify, manipulate, or manually alter the structural calculations, formulas, or outputs generated by the Platform.
  3. Remove, obscure, or alter any copyright notices, watermarks, or proprietary designations on documents generated by FamilyLawTools.
  4. Use the Platform to build a competitive product, or copy any features, functions, or graphics.
  5. Introduce malware, trojans, or any malicious code designed to disrupt, damage, or gain unauthorized access to the Platform or other users’ data.
  6. Perform unapproved penetration testing, load testing, or vulnerability scans.
  7. Resell, sublicense, or lease your account access to third parties.

3. Data Management and Privacy

3.1 Client and Case Data

You retain full ownership of all data, case files, and information you input into the Platform (“User Data”). By utilizing the Platform, you grant us a secure, restricted license to process, store, and transmit this data solely for the purpose of providing the service to you.

3.2 Data Accuracy

You are responsible for ensuring the accuracy of the information entered into the system. The use of placeholder or “dummy” values (e.g., naming a party “No Name” or “Spouse A” where real identities are required) is prohibited, as it interferes with system integrity.

3.3 Data Security

While FamilyLawTools implements robust administrative and technical safeguards to protect User Data, the transmission of information over the internet carries inherent risks. You are responsible for properly utilizing any available encryption features. We are not liable for data breaches resulting from compromised user credentials or your failure to secure your local network.

4. Billing and Subscriptions

4.1 Current Free Access

The Platform is currently provided to users entirely free of charge.

4.2 Future Paid Subscriptions

In the future, FamilyLawTools may transition to a paid service model. If and when the Platform converts to a paid service, access will be billed exclusively based upon one annual payment. There are currently no plans to offer single-use or a la carte services. We will notify users of any pricing changes or transitions to a paid model prior to implementation.

5. Intellectual Property

FamilyLawTools retains all rights, title, and interest in and to the Platform, including its underlying software, algorithms, UI/UX design, updates, and proprietary documentation. Any feedback, feature requests, or suggestions you provide may be used by us to improve the Platform without obligation or compensation to you.

6. Service Level and Warranties

6.1 Uptime Expectations

Because the Platform is currently offered as a free service, we provide absolutely no guarantee of uptime or availability. Should the Platform transition to a billed service in the future, we may target a 99% uptime metric; however, no guarantees of uptime or availability are made at any time, and no service credits or refunds will be issued for downtime.

6.2 Mandatory Verification and Disclaimer of Warranties

YOU MUST INDEPENDENTLY VERIFY ALL CALCULATIONS, FORMS, AND OUTPUTS GENERATED BY THE PLATFORM FOR ACCURACY. The Platform is provided on an “as-is” and “as-available” basis. FamilyLawTools expressly disclaims all implied warranties, including merchantability and fitness for a particular purpose. We do not guarantee that the Platform will be error-free, bug-free, or uninterrupted. We will not be held liable for any errors, omissions, negative outcomes, or damages resulting from your failure to independently verify the results produced by the Platform.

7. Limitation of Liability and Indemnification

7.1 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FAMILYLAWTOOLS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL).

7.2 Indemnification

You agree to indemnify, defend, and hold harmless FamilyLawTools, its directors, employees, and affiliates from any claims, damages, or legal expenses arising from your misuse of the Platform, your violation of these Terms, your failure to verify Platform outputs, or your mishandling of User Data.

8. Refusal of Service, Termination, and Account Suspension

8.1 Right to Terminate and Refuse Service

We reserve the right to refuse service, terminate your account, ban your access, or suspend your use of the Platform at any time, without prior notice, for any non-protected reason, at our sole and absolute discretion. This expressly includes the right to prohibit access to any individual, entity, or organization with whom FamilyLawTools, its founders, or its affiliates have experienced prior professional conflicts, disputes, or adverse interactions.

8.2 Zero-Tolerance for Abuse

FamilyLawTools is committed to providing a safe environment for our staff. Any hostile, abusive, threatening, or vulgar communication directed at our support team will result in the immediate and permanent termination of your account.

9. General Provisions

  1. No Legal Advice: FamilyLawTools provides software solutions, not legal representation. Nothing generated by our Platform constitutes legal advice. Pro se users are strongly encouraged to consult with a qualified attorney.
  2. Governing Law: These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law principles.
  3. Severability: If any provision of these Terms is found to be unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
  4. Force Majeure: Neither party will be held liable for delays or failures in performance caused by events beyond their reasonable control, including natural disasters, pandemics, acts of war, or severe infrastructure failures.
  5. Entire Agreement: These Terms constitute the entire agreement between you and FamilyLawTools regarding your use of the Platform, superseding all prior agreements or understandings.
